In 2005, a Union Pacific train derailed in Oklahoma causing extensive damage to both the railroad and the train’s cargo. Kawasaki, K-Line, and Union Pacific sought damages, alleging that Plano’s steel injection molds were improperly packed, broke through their crate, and fell onto the track. The district court granted Plano summary judgment. The Seventh Circuit affirmed in part. Negligence claims were properly rejected, Plano had no indication that the parties with which it dealt would be unable to properly package and transport its steel molds from China to the United States, nor did Plano have any special knowledge of any unique danger the molds would pose during transit. Plano owed no special duty of care to the carriers. There were, however, unresolved questions of fact material to the determination of one contract claim, based on a bill of lading. CTTA filed this action seeking to invalidate two ordinances where the City and County of San Francisco required tow truck drivers to obtain permits to operate in San Francisco and towing firms to obtain permits to conduct business within San Francisco. CTTA primarily argued that the entire "permit scheme" (as it called both ordinances) was preempted by federal law. The district court upheld the permit scheme for "non-consensual" towing, but enjoined enforcement against those doing exclusively "consensual" towing and against tow truck drivers simply "passing through" San Francisco. Both parties cross-appealed. The CTTA's challenge to the entire permit scheme necessarily encompassed all of the permit scheme's components - each of which could be preempted. The district court analyzed the permit scheme in a way the parties presented the scheme, as a whole, but without specifically addressing its individual provisions. In doing so, however, the district court ran afoul of American Trucking Associations v. City of Los Angeles, which required "examining the specific provisions" of the permit scheme. Howard and Brown ended their romantic relationship. Howard alternated between attempts to reconcile and attempts to harm Brown. Howard sent letters begging see their son, but hired someone to throw acid in her face and paid a man to shoot at the train on which she works as an engineer. He was convicted of: interfering with a passenger train engineer, with intent to endanger safety and with reckless disregard for the safety of human life, 18 U.S.C. 1992(a)(6) and (10), 1992(b)(1); committing and attempting to commit use of a firearm, with intent to cause serious bodily injury to a train company employee while such person was inside of a passenger train located on tracks used in operation of a mass transportation vehicle, 18 U.S.C. 1992(a)(7) and (10), 1992(b)(1)’ and knowingly using and carrying a firearm during and in relation to a crime of violence, 18 U.S.C. 924(c)(1)(A). The Seventh Circuit affirmed, rejecting a “prior bad acts” challenge to admission of evidence to prove that Howard took repeated actions that were consistent with motive and intent to harm Brown and upholding denial of a motion to empanel a new jury after jurors sent notes to the judge concerning Howard’s behavior during voir dire. Plaintiff found a $20 parking citation on his windshield and initiated a class action, claiming that the inclusion of personal information, such as his driver's license number, address, and weight, violated the Driver's Privacy Protection Act, 18 U.S.C. 2721, which generally makes it unlawful to disclose personal information contained in a motor vehicle record. The district court dismissed and the Seventh Circuit initially affirmed. On rehearing, en banc, the court reversed, holding that the DPPA’s general rule of non-disclosure of personal information held in motor vehicle records and its overarching purpose of privacy protection must inform a proper understanding of the other provisions of the statute. Any disclosure must comply with those legitimate uses of information identified in the statutory exceptions. The Village’s placement of protected personal information in view of the public constituted a disclosure regulated by the statute, regardless of whether plaintiff can establish that anyone actually viewed it. Plaintiffs were United States citizens or legal permanent residents who had good reason to believe they were on the Terrorist Screening Center's (TSC) no-fly list (List). They initially submitted grievances through the redress program run by the Transportation Security Administration (TSA), but the government refused to confirm or deny their inclusion on the List. Rather than continuing to pursue their administrative grievances with the TSA, Plaintiffs filed this action against the directors of the TSC and FBI and the attorney general, challenging the TSA's grievance procedures. The district court dismissed the case, holding that TSA was a necessary party to the litigation but that TSA could not feasibly be joined in the district court due to 49 U.S.C. 46110, which grants federal courts of appeals exclusive jurisdiction to review TSA's final orders. The Ninth Circuit Court of Appeals reversed, holding (1) section 46110 does not strip the district court of federal question jurisdiction over substantive challenges to the inclusion of one's name on the List; and (2) the district court's determination that TSA was a necessary party was not an abuse of discretion, but the court erred in holding that joinder of TSA was infeasible in light of section 46110. Plaintiff, a seaman, contracted lymphoma and sued his former employer, a tugboat operator, seeking maintenance and cure. The doctrine of maintenance and cure concerns the vessel owner’s obligation to provide food, lodging, and medical services to a seaman injured while serving the ship. Undisputed evidence established that the seaman had lymphoma during his maritime service, but the disease did not present any symptoms at all until after his service. The district court granted summary judgment for the tugboat operator. The Second Circuit reversed. Because the seaman’s illness indisputably occurred during his service, he is entitled to maintenance and cure regardless of when he began to show symptoms. View "Messier v. Emswiler sued his employer, CSX, a railroad, and the Brotherhood of Locomotive Engineers and Trainmen after his seniority on the roster of train engineers was adjusted. Emswiler alleged breach of collective bargaining agreement, breach of duty of fair representation, and disability discrimination under Ohio law. The district court granted defendants summary judgment. The Sixth Circuit affirmed. The district court correctly determined it could not reach the merits of claims for breach of CBA and disability discrimination due to his failure to pursue arbitral mechanisms mandated by the Railway Labor Act, which governs disputes between management and labor in the railroad industry, 45 U.S.C. 151, 153. The RLA divides disputes into two categories: Major disputes concern the formation of collective bargaining agreements, whereas minor disputes deal with the interpretation of existing CBAs. While working as a flight attendant, LeGrande was injured when the aircraft encountered severe turbulence. She sued the United States under the Federal Tort Claims Act, 28 U.S.C. 2674, alleging that air traffic controllers employed by the FAA negligently had failed to warn the flight’s captain that turbulence had been forecast along the flight path. The district court concluded that FAA employees did not breach any duty owed LeGrande and granted summary judgment for the government. The Seventh Circuit affirmed. LeGrande argued, for the first time, that her injuries resulted from the negligence of a National Weather Service meteorologist. The court concluded that the FAA breached no duty owed to LeGrande and that LeGrande failed to give the NWS the notice that the FTCA requires. View "LeGrande v. United States" on Justia Law

Philadelphia International Airport is the ninth busiest airport in the U.S. Since 1999, PHL has been among the 10 most delayed airports and has contributed to delays at airports nationwide because its runways are too short, too close together, and too few. After receiving the City’s proposal for expansion in 2003, the FAA prepared an Environmental Impact Statement. In 2008 the FAA published a three-volume, 900-page draft EIS. The EPA submitted comments, citing alleged data omissions in the FAA’s analysis. The FAA considered and responded to each of the EPA’s comments in the final EIS. Although disagreements remained, in 2010, the FAA published its Record of Decision, which approved the expansion and delineated reasons for approval, including a finding that the project was reasonably consistent with existing plans of public agencies for development of areas surrounding the airport, as required by the Airport and Airway Improvement Act (AAIA), 49 U.S.C. 47106(a)(1. Objectors alleged violations of the National Environmental Policy Act, 42 U.S.C. 4321 and the AAIA. The Third Circuit denied review, finding that the FAA decision was not arbitrary. TAMS, a medical device manufacturer, hired Comtrans to coordinate shipment of equipment to a trade show in Chicago. Comtrans is not a carrier. It used its affiliate, ACS, which retained Atlas to perform the actual shipment. The Atlas truck was involved in a serious accident, leaving TAMS with more than $1 million in losses. TAMS’s insurance company sued on behalf of TAMS. Atlas is an interstate motor carrier authorized by the Federal Motor Carrier Safety Administration to transport goods in interstate commerce. Claims are subject to the Carmack Amendment, 49 U.S.C. 14706, which provides that a carrier of property in interstate commerce is liable for the actual loss or injury to the property caused b” the carrier, which may be limited “to a value established by written or electronic declaration of the shipper or by written agreement between the carrier and shipper if that value would be reasonable under the circumstances.” Atlas relied on the contract it had in place with ACS and the bill of lading delivered signed by a Comtrans warehouse manager when Atlas picked up TAMS’s shipment, as limiting liability to $0.60 per pound.
