State of Indiana v. Norfolk Southern Railway Co.
Indiana’s blocked-crossing statute bars railroads from blocking railroad-highway grade crossings for more than 10 minutes, except in circumstances outside the railroads’ control. Ind. Code 8-6-7.5-1. Violations are Class C infractions and carry a minimum $200 fine. In one year, Norfolk Southern collected 23 blocked-crossing citations for violations near its Allen County trainyard. Norfolk argued that the Interstate Commerce Commission Termination Act (ICCTA), 49 U.S.C. 10101, and the Federal Railroad Safety Act (FRSA) expressly preempt Indiana’s statute. The trial court found that train-switching maneuvers, track congestion, and mechanical defects can all cause traffic blockages lasting more than 10 minutes, and that, to shorten blockages, Norfolk would have to run trains faster, run shorter trains, or “cut” trains into segments—an onerous process that requires more than 10 minutes of reassembly and brake tests. The court granted Norfolk summary judgment on all 23 citations. The Court of Appeals reversed. The Indiana Supreme Court reinstated the trial court decision. Indiana’s blocked-crossing statute is a remedy that directly regulates rail operations, so the ICCTA categorically preempts it. View "State of Indiana v. Norfolk Southern Railway Co." on Justia Law
Whatley v. Canadian Pacific Railway Ltd.
The Eighth Circuit reversed the district court's order finding that the trustee's claim under the Carmack Amendment against Canadian Pacific was untimely. This appeal stemmed from a train accident killing 47 people and destroying an entire town in Quebec. The court held that WFE's claim based on a claim letter and denial in April 2014 made the trustee's April 2016 lawsuit timely. In regard to Irving Oil, the court held that there was a genuine dispute over the very existence of contractual terms in the bill of lading providing for a nine-month notice period and a two-year suit limitation, precluding both dismissal on the pleadings or summary judgment as a matter of law. BNSF Railway Co. v. California Department of Tax and Fee Administration
The Ninth Circuit affirmed the district court's preliminary injunction preventing implementation of California Senate Bill 84, which requires railroads to collect fees from customers shipping certain hazardous materials and then to remit those fees to California. The district court held that the railroads were likely to succeed on the merits of their claims. The panel agreed and held that SB 84 was preempted under the Interstate Commerce Commission Termination Act because it had a direct effect on rail transportation, and it was not protected from preemption by the Hazardous Materials Transportation Uniform Safety Act because the fees authorized by SB 84 were not "fair." The panel also held that the district court did not abuse its discretion in evaluating irreparable harm, the balance of the equities, and the public interest. View "BNSF Railway Co. v. Vilcek v. Uber Technologies, Inc.
The Eighth Circuit affirmed the district court's dismissal of an action brought by four taxicab drivers against Uber, alleging that Uber tortiously interfered with a valid business expectancy. The court held that it need not decide whether there was a valid business expectancy because plaintiffs failed to allege the absence of justification under Missouri law. In this case, there was no evidence that the legislature intended to create a private cause of action based on violation of the Missouri Taxicab Commission's code and requirements. View "Vilcek v. Ward v. Soo Line Railroad Co.
Ward injured his shoulder and back when his seat collapsed in the train he was operating. Ward is a U.S. resident who is employed by a U.S. railroad, normally covered by the Federal Employers’ Liability Act (FELA), 45 U.S.C. 51. Because Ward’s seat collapsed across the border in Ontario, the FELA does not apply. Instead, Ward pursued his tort claims under state common law. The district court rejected Ward’s claims by holding that another federal law, the Locomotive Boiler Inspection Act (LIA), 49 U.S.C. 20701, preempted all state tort law remedies for injuries caused by locomotive equipment. The Seventh Circuit affirmed. The federal railroad-safety statutes left plaintiff one path that is viable and not preempted: He could assert state-law tort claims against the defendants that borrow the applicable standards of care from the federal LIA and its regulations governing the safety of locomotive equipment. Plaintiff pursued that viable theory in the district court, but, on appeal, waived any claim based on this theory. View "Ward v. Soo Line Railroad Co." on Justia Law
HDI-Gerling America Insurance Company v. Carlile Transportation Systems, Inc.
One night in February 2014 Carlile Transportation Systems, Inc. driver Bart Neal was driving a tractor-trailer southbound on the Dalton Highway. Neal could not steer properly at speeds above 35 miles per hour and decided to stop to put chains on his tires, partially blocking both traffic lanes, and, by his account, activated his flashers. Neal did not deploy reflective triangles. Eggor Enterprises, Inc. driver Joe Seurer was hauling a load of fuel northbound. By his account, Seurer saw lights in the distance but could not determine what they were. Seurer slowed his tractor-trailer from 50 to 35 miles per hour. About three-quarters of a mile from Neal, Seurer again saw lights and thought they might be from a pipeline maintenance truck stopped off the side of the road. He did not see reflective triangles or flashers. The road had an S-curve between Seurer and Neal. Until Seurer rounded the final curve, he did not realize Neal’s rig was blocking the road. Seurer applied his brakes about 300 feet from Neal, avoiding a serious collision but causing Seurer’s trailer to fall onto the side of the highway. The trailer’s fuel load spilled alongside the road. Eggor Enterprises’s insurer, HDI-Gerling American Insurance Company (HDI), paid over $3.5 million in cleanup costs to remediate the spill. HDI-Gerling, as subrogee of its trucking company client, sued Carlile for negligence. After a trial the jury determined that Carlile company’s driver was not negligent and returned a defense verdict. The insurance company appealed some of the superior court’s trial rulings. Seeing no reversible error, the Alaska Supreme Court affirmed the superior court’s entry of final judgment. Newark Cab Association v. City of Newark
Plaintiffs, licensed taxi and limousine operators, sued under 42 U.S.C. 1983, challenging an agreement between Newark and Uber as violating their rights under the Takings, Due Process, and Equal Protection Clauses. In order to operate in Newark without taxi medallions or commercial driver’s licenses, setting its own rates, Uber agreed to pay the city $1 million per year for 10 years; to provide $1.5 million in liability insurance for each of its drivers; to have a third-party provider conduct background checks on its drivers. The Third Circuit affirmed the dismissal of the suit. The agreement places the plaintiffs in an “undoubtedly difficult position” but the situation cannot be remedied through constitutional claims. Even if plaintiffs have a legally cognizable property interest in the medallions themselves, they remain in possession of and able to use their taxi medallions to conduct business. The decrease in the market value of the medallions is not sufficient to constitute a cognizable property interest necessary to state a claim under the Takings Clause. The city controls the number of medallions in circulation and maintains the ability to flood the market with medallions. With respect to equal protection, it is rational for the city to determine that customers require greater protections before accepting a ride from a taxi on the street than before accepting a ride where they are given the relevant information in advance. Lincoln v. BNSF Railway Company
Several years after a tank car spill accident, appellants Larry Lincoln and Brad Mosbrucker told their employer BNSF Railway Company (“BNSF”) that medical conditions attributable to the accident rendered them partially, permanently disabled and prevented them from working outdoors. BNSF removed appellants from service as Maintenance of Way (“MOW”) workers purportedly due to safety concerns and because MOW work entailed outdoor work. With some assistance from BNSF’s Medical and Environmental Health Department (“MEH”), Appellants each applied for more than twenty jobs within BNSF during the four years following their removal from service. After not being selected for several positions, Appellants filed charges with the Equal Employment Opportunity Commission (“EEOC”), accommodation request letters with BNSF, and complaints with the Occupational Safety Health Administration (“OSHA”). Following BNSF’s rejection of their applications for additional positions, Appellants filed a complaint raising claims for: (1) discrimination under the Americans with Disabilities Act (“ADA”); (2) failure to accommodate under the ADA; (3) retaliation under the ADA; and (4) retaliation under the Federal Railroad Safety Act (“FRSA”). Relying on nearly forty years of Tenth Circuit precedent, the district court concluded that filing an EEOC charge was a jurisdictional prerequisite to suit and it dismissed several parts of Appellants’ ADA claims for lack of jurisdiction. Appellants also challenged the vast majority of the district court’s summary judgment determinations on the merits of their claims that survived the court’s exhaustion rulings. After polling the full court, the Tenth Circuit overturn its precedent that filing an EEOC charge was a jurisdictional prerequisite to suit, thus reversing the district court’s jurisdictional rulings. Appellants’ ADA discrimination and ADA failure to accommodate claims relative to some of the positions over which the district court determined it lacked jurisdiction were remanded for further proceedings. With respect to the district court’s summary judgment determinations on the merits of appellants’ claims that survived the exhaustion rulings, the Tenth Circuit was unable to reach a firm conclusion on the position-based ADA discrimination and failure to accommodate claims. The Court concluded the district court’s dismissal of the FRSA claims were appropriate. Therefore, the Court reversed in part, affirmed in part and remanded this case for further proceedings. Bishop v. Air Line Pilots Association, International
United Airlines pilot instructors sued their union, ALPA, alleging that ALPA had breached its duty of fair representation in its allocation of a retroactive pay settlement among different groups of pilots. The district court dismissed the case. The Seventh Circuit reversed. A claim of discrimination or bad faith must rest on more than a showing that a union’s actions treat different groups of employees differently and must be based on more than the discriminatory impact of the union’s otherwise rational decision to compromise. The Instructors sufficiently and plausibly pleaded that ALPA acted in bad faith in its allocation of retroactive pay between the line pilots and pilot instructors. A union may not make decisions “solely for the benefit of a stronger, more politically favored group over a minority group.” The plaintiffs have alleged that pilot instructors make up a minority of ALPA’s membership and that ALPA acted with the intent to appease its majority membership, the line pilots, after a lengthy and contentious CBA negotiation. BNSF Railway Co. v. Seats, Inc.
Plaintiff filed the underlying action against BNSF after he was injured when the backrest of his locomotive seat broke, and alleged that the seat did not comply with the federal standards in the Locomotive Inspection Act (LIA). BNSF settled a Federal Employers' Liability Act (FELA) claim with plaintiff.BNSF then filed suit against Seats to recover the costs of settlement. The Eighth Circuit reversed and held that the district court erred in determining that the LIA preempted BNSF's claims for products liability and breach of contract. Because the district court did not address defendant's other grounds for dismissal of the two claims, the court remanded for further proceedings on those alternative arguments.
